Article 15 – Prohibition of Discrimination
Clause (1)
- State shall not discriminate against any citizen only on grounds of:
- Religion
- Race
- Caste
- Sex
- Place of birth
Clause (2)
- No citizen shall face any disability, restriction or conditionon the above grounds regarding:
- (a) Access to shops, public restaurants, hotels, places of public entertainment
- (b) Use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of State funds or dedicated to public use
Clause (3)
- State may make special provisions for women and children
Clause (4)
- State may make special provisionsfor:
- Socially and educationally backward classes
- Scheduled Castes (SCs)
- Scheduled Tribes (STs)
Clause (5)
- State may make special provisions by law for advancement of:
- Socially and educationally backward classes
- SCs and STs
- Related to admission to educational institutions, including:
- Private institutions (aided or unaided)
- Excludes minority educational institutions under Article 30(1)
Clause (6)
- State may make special provisions for Economically Weaker Sections (EWS)other than classes under clauses (4) and (5):
- (a) General advancement
- (b) Admission to educational institutions (including private, aided or unaided)
- Reservation:
- Maximum 10%
- In addition to existing reservations
- Excludes minority educational institutions under Article 30(1)
